Minnesota Privacy Policy
Last Updated: September 4, 2025
This supplement provides further guidance for individuals residing in Minnesota in accordance with the Minnesota Consumer Data Privacy Act (MNCDPA). Any terminology appearing in this segment holds the same definitions as those in the MNCDPA. It does not encompass details that fall outside the scope of "personal data," including anonymized or openly accessible information as specified under the MNCDPA.
Data Transactions and Customized Promotions
Our organization engages in "sales" of select personal data to external entities, as outlined in the MNCDPA, covering categories such as unique individual indicators, online engagement records, and geographic details.
We handle personal data to facilitate tailored marketing, per the MNCDPA, involving online markers and digital activity. This helps us present promotions that align more closely with your interests.
You can choose to exclude yourself from these activities via compliance@xendurance.com.
Automated Assessments
Our practices do not involve automated evaluations aimed at outcomes with substantial legal or equivalent implications.
Your Protections Under MNCDPA
The safeguards offered by the MNCDPA are outlined below. To initiate a privacy inquiry, email compliance@xendurance.com.
Access Privileges
You can confirm whether we are managing your personal data and retrieve that information. You are eligible to obtain a copy in a transferable and user-friendly format that enables sharing with another entity.
If you submit an access inquiry more than twice within a 12-month timeframe, or if we deem it clearly unwarranted or overly burdensome, a minor charge may apply.
Privilege to Acquire Third-Party Roster
You are entitled to request a compilation of the precise external entities to which we have shared personal data. We have shared or may share personal data with these entities:
Shoppay
Shopify Network Intelligence
Google Ads
Google Analytics
Google Pay
Klarna
Meta Ads
Microsoft Ads
PayPal - Pay with PayPal, Venmo, Pay Later
Pinterest Ads
Snapchat Ads
Tiktok Ads
Erasure Privileges
You may direct us to eliminate any personal data we have gathered about you. We will completely remove it from our systems and instruct our vendors to do the same, although we might retain it if required for particular lawful reasons. Any retained information for these reasons will not be managed for alternative objectives.
Safeguard Against Unfair Treatment
Exercising your MNCDPA privacy protections will not result in biased actions from us, such as modified pricing or diminished service quality.
We will avoid any form of reprisal against you in positions like employee, job applicant, or independent contributor for utilizing these protections.
Withdrawal Options
For data transactions: Activate your withdrawal choice via compliance@xendurance.com.
For customized promotions: Activate your withdrawal choice via compliance@xendurance.com.
For automated assessments: Our operations do not include evaluations linked to decisions with legal or similarly critical effects.
Appointed Representatives
You can designate a representative to file a withdrawal request on your behalf, potentially using mechanisms like a website link, browser configuration, or device-wide preference. We will honor these if we can verify your identity and the representative's legitimacy to proceed for you.
Automatic Withdrawal Indicators
Certain browser options allow the automatic dispatch of a withdrawal signal, such as the Global Privacy Control (GPC), to services you access. Upon identifying this, we implement a U.S.-specific privacy marker in your browser, leading compliant third parties to cease monitoring your site interactions. This withdrawal associates only with your browser's unique identifier, not with any profile details, given our lack of knowledge about browser-profile connections. GPC is available on select browsers or as an extension; discover activation instructions here.
Rectification Privileges
You can seek adjustments to flaws in your personal data, evaluating the data's nature and our management intentions.
Automated Assessment Entitlements
Our activities exclude automated evaluations directed at determinations with notable legal or comparable consequences.
Validating Your Inquiry
After receiving your inquiry, we will cross-reference the supplied details with our collected records. If confirmation fails, we may request more information. Inability to provide extras or to confirm through standard practices could cause rejection.
Challenge Process
Should we refuse to act on any privacy inquiry, you can contest that refusal reasonably soon, within 90 days of our notification. To file a challenge, email compliance@xendurance.com and note "Appeal a Decision" in the title.
If you suspect your protections have been infringed and cannot settle it directly with us, you may lodge a grievance with the Minnesota Attorney General’s Office.
