This addendum excludes data that falls outside the definition of "personal data," including anonymized details or information accessible to the public as specified under the TDPSA.

Sharing and Promotional Use of Data

Our organization transfers specific personal data to external entities in a manner that qualifies as a "sale" under TDPSA definitions, encompassing categories like unique identifiers for individuals, online behavior records, and geographic positioning data.

We handle personal data to facilitate customized promotions, as described in the TDPSA, covering areas such as individual identifiers, online interactions, purchasing details, and location specifics. This enables the delivery of advertisements tailored to your interests.

To withdraw from these activities, you can submit an opt-out request via compliance@xendurance.com.

Automated Decision-Making

Under the TDPSA, individuals can choose to exclude themselves from automated analysis that leads to outcomes with substantial legal or equivalent impacts, including decisions on credit approval, job opportunities, or coverage for insurance.

Our practices do not involve such automated analysis for decisions yielding legal or comparably important consequences for individuals.

Access Rights

You are entitled to verify if we are handling your personal data and to retrieve that information. In cases where automation is involved in processing, you may obtain a transferable copy of your data in an easily usable structure, enabling you to share it with another entity.

Should you submit more than two access requests within a one-year span, or if we deem the request unwarranted, overly frequent, or duplicative, a nominal charge may apply to the request.

Deletion Rights

You can ask us to erase any personal data we have gathered from or about you. With some exceptions, we will fully remove this data from our systems and instruct our service providers to follow suit.

Protection Against Discrimination

Exercising your privacy entitlements under TDPSA will not result in unfair treatment from us, such as altered pricing or diminished service standards.

Opt-Out Entitlements

For automated decision-making: Our operations do not include analysis aimed at decisions with legal or similarly critical effects.

Designated Representative

You have the option to designate a representative to handle an opt-out request for you, potentially via tools like a website link, browser configuration, or device-wide preference. We will honor these if we can confirm your identity and the representative's legitimacy to represent you.

Automated Opt-Out Indicators

Certain browser configurations enable the automatic sending of an opt-out indicator, like the Global Privacy Control (GPC), to visited services. Upon detecting this, we apply a U.S.-specific privacy indicator in your browser, ensuring compliant third parties cease monitoring your site activity. This opt-out ties solely to your browser's unique identifier, not to any profile data, since we lack visibility into browser-account linkages. Correction Rights

You may seek to amend errors in your personal data, considering the type of information and our reasons for handling it.

Verifying Your Submission

After receiving your submission, we will cross-check the details you supply against our records. If verification fails, we might request more details. Inability to provide extras or confirm via standard methods could lead to rejection of the submission.

Appeal Process

Should we refuse to fulfill any privacy submission, you can challenge that refusal reasonably promptly, no more than 90 days after our notification. For an appeal submission, please email compliance@xendurance.com.
