Montana Privacy Policy

Last Updated: September 4, 2025

This supplement offers further details for individuals in Montana pursuant to the Montana Consumer Data Privacy Act (MCDPA). All terminology in this part aligns with the definitions provided in the MCDPA. It excludes information not deemed "personal data," such as anonymized or openly available material as outlined in the MCDPA.

Data Transactions and Personalized Marketing

Our entity conducts "sales" of specific personal data to outside parties, per the MCDPA's definition, covering categories like unique individual markers, web usage records, and geographic details.

We manage personal data to support customized promotions, as defined by the MCDPA, involving items such as individual markers, web interactions, purchasing records, and geographic information. This enables us to deliver promotions that better suit your preferences.

You can elect to withdraw from these activities by emailing compliance@xendurance.com.

Automated Evaluations

The MCDPA permits individuals to exclude themselves from automated assessments that lead to outcomes with notable legal or equivalent implications, including decisions related to financing, hiring, or coverage.

Our operations do not include such automated assessments for decisions with legal or comparably important results.

Your Safeguards Under MCDPA

The protections granted by the MCDPA are summarized below. To begin a privacy inquiry, email compliance@xendurance.com.

Access Privileges

You can verify if we are handling your personal data and obtain that information. You are eligible to get a copy in a movable and practical format that supports transfer to another entity.

Submitting an access inquiry more than once within a 12-month period, or if we view it as clearly baseless or overly demanding, may result in a modest fee.

Erasure Privileges

You may direct us to remove any personal data we have acquired about you. We will fully erase it from our systems and notify our vendors to do the same, though retention may be allowed if needed for specific lawful objectives.

Any kept information for these objectives will not be handled for unrelated purposes.

Protection from Bias

Invoking your MCDPA privacy safeguards will not trigger unequal treatment from us, such as different rates or varied product quality.

We will avoid any form of reprisal against you in roles like worker, job seeker, or freelance associate for utilizing these safeguards.

Withdrawal Options

For data transactions: Engage your withdrawal choice via compliance@xendurance.com.

For personalized marketing: Engage your withdrawal choice via compliance@xendurance.com.

For automated evaluations: Our activities do not encompass assessments tied to decisions with legal or similarly vital effects.

Designated Proxy

You can appoint a proxy to file a withdrawal request on your behalf, possibly through tools like a site connection, browser preference, or broad device option. We will fulfill these if we confirm your identity and the proxy's authorization to represent you.

Automatic Withdrawal Indicators

Browser configurations might allow the automatic sending of a withdrawal signal, such as the Global Privacy Control (GPC), to platforms you visit. When detected, we set a U.S.-oriented privacy indicator in your browser, prompting compliant third parties to stop tracking your site behavior. This withdrawal connects only to your browser's specific identifier, not to profile data, given our unawareness of browser-profile links. GPC functions on certain browsers or as add-ons; explore enabling steps here.

Rectification Privileges

You can request fixes to errors in your personal data, taking into account the information's characteristics and our handling goals.

Validating Your Inquiry

Following receipt of your inquiry, we will align the provided details with our records for validation. If we cannot confirm it, additional details may be requested. Failure to supply more or to confirm through typical methods could lead to rejection.

Challenge Mechanism

If we opt not to proceed with a privacy inquiry, you can dispute that choice in a reasonable timeframe, no more than 90 days after our notice. To lodge a challenge, email compliance@xendurance.com and note "Appeal a Decision" in the title.

Should you believe your safeguards have been infringed and cannot resolve it with us, you may present a grievance to the Montana Attorney General’s Office
